The rules of the
road for residential mortgage servicing have changed significantly since the
crash in 2008. Since then, a wide variety of agencies, including Congress,
federal banking regulators, state attorneys general and the California
legislature, have all sought to improve loan servicers’ practices, particularly
in connection with the loss mitigation process. The result is a series of
