West Virginia v. EPA: Climate Regulation - March 4, 2022

The Implications of West Virginia v. EPA for Climate Regulation in the United States

Sponsored by the American Constitution Society

The decade-long battle over EPA's authority to regulate carbon pollution from power plants will finally be heard by the Supreme Court on February 28, 2022. West Virginia v. EPA could be decided on narrow grounds, such as whether the EPA properly repealed the Obama Administration's Clean Power Plan, or it could have significant implications for the power of the Clean Air Act to stem climate-change causing emissions from the largest sources in the country, or even impact the ability of agencies to issue rules interpreting and carrying out their statutory duties.

Join us for a discussion of these important issues. The discussion will be moderated by Kathryn Hoffman, the CEO of the Minnesota Center for Environmental Advocacy, which is a party in the case. She will be joined by four environmental and administrative law attorneys who have been integral to the development of this case since its inception, and will read the tea leaves following following this week’s argument.

Panelists:
Jay Duffy, Attorney, Clean Air Task Force
David Doniger, Senior Strategic Director in the Climate & Clean Energy Program, Natural Resources Defense Council
Jody Freeman, Archibald Cox Professor of Law and Director of the Energy and Environmental Law Program, Harvard Law School
Steven Wu, Deputy Solicitor General, Office of the New York State Attorney General
