2021 eDiscovery Trends in Proportionality, Rule 34 Responses, and Sanctions
Sponsored by Innovative Driven
It has been six years now since rule makers enacted the last set of amendments to the Federal Rules of Civil Procedure and it’s fairly apparent those changes have impacted electronic discovery practice issues. In this program, a panel of experts will examine rules and practice areas that have been particularly impacted, discuss trends and issues arising from case law, and offer best practices for addressing those issues.
Topics covered include:
- How the Rule 26(b)(1) proportionality factors are affecting discovery practices from preservation to production to privilege logging
- The impact of Rule 34(b)(2)(B)’s specificity requirement on discovery objections and responses and whether courts are turning to Rule 37(a)(5)(A) sanctions to curb boilerplate objections and other discovery abuses
- The seemingly growing prevalence of sanctions motions under Rule 37(e) for alleged failures to preserve relevant electronically stored information
