The transatlantic transfer of personal data between the European Union and the United States is now governed by new data privacy compliance obligations under the EU-US Privacy Shield following an October 2015 ruling that invalidated the previous Safe Harbour privacy accord. For businesses, this means a new set of rules to learn and a new set of standards to follow.
Businesses and their legal representation must identify and implement new plans for information governance, eDiscovery processes and enterprise-level operations with built-in contingencies for future revisions given that the Article 29 Working Party has recently issued an opinion regarding the European Commission’s initial adequacy opinion on Privacy Shield.
