Title IX and Sexual Assault on Campus

The American Constitution Society is pleased to present a panel discussion addressing the difficult issue of Title IX and sexual assault in higher education. Since 2011, the Obama administration has taken an active role in the movement to end campus sexual assaults, including the formation of a Task Force on the issue, which released its first report in 2014. As part of this effort, the U.S. Department of Education has reinvigorated its enforcement of Title IX, issuing guidance letters and conducting investigations on a growing list of higher education institutions. In response, academic institutions have ramped up efforts to investigate sexual assaults and make their campuses safer. At the same time, however, some, including 28 Harvard Law School professors, have expressed concern that while stemming the epidemic of campus sexual assault is paramount, it is important to have fair processes and procedures in place to protect both the victim and the accused.

Our panel of experts, coming from an array of different backgrounds, will offer their thoughts and experiences in Title IX compliance and sexual assault investigations.

 Speakers:
  • Jill Habig is a Special Assistant Attorney General in the California Attorney General's office, who advises the AG on issues of education and civil rights, including the collaboration of higher education personnel and law enforcement in the enforcement and investigation of sexual violence.
  • Kendra Fox-Davis is an Attorney in the San Francisco office of the Office of Civil Rights (OCR), where she investigates Title IX complaints on behalf of the U.S. Department of Education.
  • Dan Roth is a criminal defense attorney who has represented individuals in relation to Title IX sexual assault proceedings. 
  • Moderator: Seth Grossman, Chief of Staff to University of California President Janet Napolitano.
