Limited Scope Representation - 1.50 units Ethics - August 4, 2015

Limited Scope Representation 2015: Ethical & Practical Challenges

Sponsored by Practising Law Institute

To respond to the access to justice crisis facing the legal system, the civil legal services community and the judiciary have partnered in the expansion of services based on limited scope representation. Information tables, drop-in legal clinics, websites and help lines are all models in which an attorney takes limited responsibility for a client’s case. Many of these models expand access by employing volunteer attorneys and law students to provide services on a “limited scope” basis. This program will address the ethical and practical issues and concerns arising from the diversification and expansion of this model of representation.

What You Will Learn
  • Update on ethical issues in limited scope representation, including competence, communications and the attorney-client relationship, candor before the tribunal and diminished capacity
  • Supervisory issues and best practices
  • Ethical and practical issues in helping the pro se litigant prepare pleadings and motions
  • Best practices in limited scope representation programs.
 Speakers:
  • Brenna K. DeVaney ~ Pro Bono Counsel, Skadden, Arps, Slate, Meagher & Flom LLP

Title IX and Sexual Assault on Campus - Live in SF - August 4, 2015

Title IX and Sexual Assault on Campus

Sponsored by the American Constitution Society

The American Constitution Society is pleased to present a panel discussion addressing the difficult issue of Title IX and sexual assault in higher education. Since 2011, the Obama administration has taken an active role in the movement to end campus sexual assaults, including the formation of a Task Force on the issue, which released its first report in 2014. As part of this effort, the U.S. Department of Education has reinvigorated its enforcement of Title IX, issuing guidance letters and conducting investigations on a growing list of higher education institutions. In response, academic institutions have ramped up efforts to investigate sexual assaults and make their campuses safer. At the same time, however, some, including 28 Harvard Law School professors, have expressed concern that while stemming the epidemic of campus sexual assault is paramount, it is important to have fair processes and procedures in place to protect both the victim and the accused.

Our panel of experts, coming from an array of different backgrounds, will offer their thoughts and experiences in Title IX compliance and sexual assault investigations.

 Speakers:
  • Jill Habig is a Special Assistant Attorney General in the California Attorney General's office, who advises the AG on issues of education and civil rights, including the collaboration of higher education personnel and law enforcement in the enforcement and investigation of sexual violence.
  • Kendra Fox-Davis is an Attorney in the San Francisco office of the Office of Civil Rights (OCR), where she investigates Title IX complaints on behalf of the U.S. Department of Education.
  • Dan Roth is a criminal defense attorney who has represented individuals in relation to Title IX sexual assault proceedings.
  • Moderator: Seth Grossman, Chief of Staff to University of California President Janet Napolitano.

Handling Terabytes of Data - Ethics - August 6, 2015

Making a Molehill Out of a Mountain: Tips for Handling Terabytes of Data

Sponsored by Bloomberg BNA and Catalyst

Two of the key goals for companies involved in litigation and responding to e-discovery requests are identifying the information that is relevant to understanding the case and identifying the information that is responsive to the opponent’s production requests.  This webinar will discuss strategies that should help a litigant accomplish these goals while minimizing the costs and burdens associated with managing a large volume of data.

Using early case assessment tools and review workflow techniques, the case team may be able to prioritize the review and production, reducing the massive volume of data to a more manageable level, and thereby reducing time and cost.

Educational Objectives:

An attendee of this webinar can expect to learn:
• Ways to identify relevant data sources;
• Techniques for identifying potentially responsive data;
• A description of new technologies and how to use data analytics tools, such as “technology assisted review;”
• Considerations in selecting an e-discovery partner/vendor;
• Suggestions for good practices, including documentation and cooperation.

Due Diligence and Third-Party Risk Management - 1-1/2 units - August 6, 2015

A Holistic Approach to Due Diligence and Third-Party Risk Management

Sponsored by LexisNexis

Many companies have implemented robust due-diligence vetting, monitoring and auditing strategies for managing third-party risk. No due diligence system is foolproof in identifying high-risk business partners or predicting which partners will engage in bribery and where they might conspire with employees to circumvent even the best-intentioned vetting process.

Join Michael Volkov and Richard Bistrong as they discuss how due diligence systems, and monitoring and auditing strategies can be used to identify sophisticated bribery schemes in today’s evolving global economy.

During the webinar attendees will learn:
  • How to better understand the third-party perspective of due-diligence vetting and the party’s view of anti-bribery laws.
  • Techniques for monitoring business partners who may present moderate risks on paper, but who in reality may be high-risk business partners;
  • How to spot and resolve hidden red flags that may arise in the due-diligence vetting process and during the life of the relationship;
  • How to develop appropriate reporting roles in the organization during the due diligence on-boarding process.
  • Auditing strategies for financial and compliance professionals to apply to a range of business partners as a reliable means to isolate those who present unique risks.

Ten Evidentiary Missteps to Avoid - 1-1/4 units - August 18, 2015

Lessons From the 'Serial' Case: Ten Evidentiary Missteps to Avoid

Sponsored by LexisNexis

Evidence is the lifeblood of a case. And your client’s livelihood or bottom line, liberty or life, may depend on how you handle it.

There is no better illustration of this than a 1999 Maryland case involving the murder of an 18-year-old high school senior, Hae Min Lee, and the controversial conviction of her ex-boyfriend, Adnan Syed, then 17. The case inspired the record-breaking Serial podcast, which has been downloaded more than 80 million times. The case continues to inspire millions of downloads of Undisclosed, a podcast which features three attorneys who enthusiastically run down the many rabbit holes of the case’s hotly disputed evidentiary issues. It was evidentiary concerns that prompted an appellate ruling calling for a new look at the case.

Undisclosed was initiated by the same attorney who inspired the production of Serial, Rabia Chaudry, a close family friend of the defendant and an ardent advocate for his release. Joining Chaudry on Undisclosed are two attorneys with a penchant for evidentiary matters. Susan Simpson, an associate with the Volkov Law Group, handles both civil and criminal actions, and writes the blog The View From LL2 The other is Colin Miller, a professor and associate dean at the University of South Carolina School of Law and author of the popular Evidence Prof Blog.

What You Will Learn

Simpson and Miller will share what they believe the so-called Serial case can teach civil and criminal attorneys, courts, the prosecution and defense about evidence – and what not to do with it. They will use Maryland v. Syed to illustrate 10 evidentiary pitfalls, their consequences and how to avoid them.
